John Dee Carruth, the former president/CEO of the now conserved Alabama One Credit Union of Tuscaloosa, Ala., has filed to dismiss the administrator of the Alabama Credit Union Administration, Sarah Moore, from a lawsuit that had named her as a defendant in addition to several lawyers, at least one law firm and Alabama state officials.

Papers filed with the U.S. District Court for Northern Alabama did not reveal why Carruth sought dismissal of the complaint against Moore, but they made clear that he wanted her dismissed without prejudice.

In addition, attorneys Jeven Sloan and David Dreary of the Dallas, Texas-based law firm Loewinsohn Flegle Dreary, LLP, filed a motion with the court for permission to withdraw from representing Alabama One Credit Union.

When the ACUA conserved the credit union on August 27, the attorneys said they received correspondence from the ACUA that terminated their firm's representation of the credit union, they wrote in their filing.

They also wrote that they would continue to represent Carruth in the case.
