HR Departments Advised to Stay the Course Despite Latest OT Rules Controversy

WASHINGTON – The latest chapter in the Department of Labor’s (DOL) revised yet controversial overtime rules may have hit yet another obstacle. According to the Associated Press, the House in a 223-193 vote moved to block the revised rules, which took effect August 23. Introduced by Reps. David Obey (D-Wis.) and George Miller (D-Calif.), the amendment to the Labor, Health and Human Services appropriations bill would prohibit DOL spending to implement or administer the new rules except for a higher salary level threshold for exempt status. While the general expert opinion is that the new regulations have had little impact on credit unions, Society for Human Resource Management Director of Governmental Affairs Mike Aitken advises all HR professionals to continue to abide by the revised rules until the bill’s ultimate fate is determined. To that end, DOL has launched an Internet tool dubbed eLaws Advisor, designed to help employers comply with the new Fair Labor Standards Act rules on eligibility for overtime pay. The eLaws Web site is www.dol.gov/elaws/overtime.htm. As for the House’s latest move, in general, Congress is supposed to approve all appropriations bills prior to the start of the federal government’s fiscal year on Oct. 1.
