AUSTIN, Texas – The Texas Savings & Loan Department issued an amendment effective June 1 concerning mortgage advertising in the state. The rule applies to mortgage brokers specifically, but mortgage CUSOs in the state that are licensed as mortgage brokers are affected. The first rule amendment requires mortgage brokers to provide in advertisements for mortgage loans the following information: whether the mortgage broker or loan officer is a creditor for purposes of Reg Z; the advertising include the name and license number of the mortgage broker or loan officer or business entity the broker or loan officer conducts business through; a physical street address for the mortgage broker, loan officer or business entity; and their license number. In addition, the ad must include the amount or percentage of any down payment; the number of payments or period of repayment; the amount of any payment; the amount of any finance change; and the closing costs.
