WEST PALM BEACH, Fla. – This latest ABA lawsuit is the third challenging an NCUA policy or practice. The other two have failed. Will the third time be the charm for the ABA? Credit Union Times’ new voting poll poses that question. It reads as follows: “The American Bankers Association’s latest lawsuit against NCUA challenges the agency’s FOM policies, specifically community charters. The ABA is using NCUA’s six-county community charter approval for Utah-based Tooele FCU as the classic case for NCUA overstepping its rules. The bankers say one of NCUA’s own requirements for a community charter is “a well-defined local community” and it broke that rule by giving the $160 million Tooele FCU access to 60% of Utah’s population.
