WASHINGTON-NCUA told UCF Federal Credit Union CEO Michael Murray that his credit union could perform mortgage servicing as a charitable contribution for an area chapter of Habitat for Humanity, as long as they stay within the parameters of the charitable giving regulation. However, because Murray is going to serve on the board of the local chapter, he may not participate in the credit union board’s vote to determine whether the institution will participate. “We caution that the FCU Bylaws prohibit a director, committee member, officer, agent or employee of the credit union from participating in the deliberation on any matter affecting his or her pecuniary or personal interest or the pecuniary interest of any corporation in which he or she is directly interested,” Associate General Counsel Sheila Albin wrote. UCF also asked whether the Habitat for Humanity chapter had to be a member in order for the credit union to service the loans. Albin wrote that this was not necessary so long as the credit union provided the mortgage servicing free of charge as a charitable contribution.
